China is a first-to-file country. A registration in the US, the UK or the EU does not protect your brand in China, and factories, distributors and professional squatters do file the brand names they see on purchase orders and packaging. Once someone else holds the Chinese registration, it becomes harder to stop counterfeits being made in China, and in some cases the holder tries to use it against your own goods leaving the country.
We search the Chinese register for identical and similar marks in the classes and subclasses that cover your products, check whether your factory or anyone else has already filed your name, advise on whether you need a Chinese-character mark, and file in the classes you actually need. Chinese subclasses are narrower than many sellers expect, so a filing that looks complete can leave gaps.
If your mark has already been filed by someone else, we look at the filing date, any use and the evidence of bad faith, then choose between opposition, invalidation, a non-use cancellation or, where it is cheaper and faster, a negotiated buy-back.
