The first step in a cross-border succession matter is usually not immediate distribution. It is building a reliable record of family relationships, documents and assets.

When the deceased, family members, real estate, bank accounts, company shares or important documents are spread across jurisdictions, an estate matter can involve family relationships, wills, asset status, cross-border document use and separate procedures at different institutions.

For an overseas family, delay commonly arises not from a lack of legal rules but from incomplete information, documents that do not connect family relationships, uncertain assets or steps taken before rights are clarified.

Working principle: identify the potential heirs, wills and assets before selecting a notarial, negotiated, court or other route. Different assets and family circumstances should not be forced into a single template.

1. Build a four-part factual record

01 / FAMILY

Who may have rights?

Organise marital, child, parent and other relevant family relationships, including adoption, remarriage or a potential heir who died earlier.

02 / WILL

Is there a will or other arrangement?

Wills, gifts, family agreements, insurance arrangements, company documents and trust-related materials may all affect the issues to be confirmed.

03 / ASSETS

Where are the assets?

Real estate, deposits, shares, investments, receivables, vehicles, IP and operating assets should be identified by name, location, registration and available records.

04 / DOCUMENTS

Can the documents be used in China?

Death, relationship, marriage, identity and authority documents issued outside China may require preparation appropriate to their intended use.

2. A legal work path can help to

3. What to prepare for an initial discussion

STEP 01

Basic family information

Names, relationships, nationality or residence, date of death and whether a will is known to exist.

STEP 02

Asset leads

Known real-estate addresses, banks, company names, investment accounts, receivables or any record that can help locate an asset.

STEP 03

Documents and goals

Explain documents already held, relevant deadlines, family disagreements and the preliminary outcome the family seeks.

Clarify rights and assets before arranging cross-border documents and next steps.

A sound factual record makes cross-border family and asset matters more orderly and can avoid unnecessary procedural and family cost.
